When is a twin not a twin?

Marshall Hall Levy were recently instructed to act by one of the parties when a Local Authority made an application for a Care Order for a set of twins. In this application they sought the Courts permission to remove the children from the parents due to concerns about the way in which the children were being brought up.

 

As this matter moved forward the Local Authority discovered that two men claimed to be the children’s father. This resulted in the Court granting permission for DNA analysis of the children, the mother and the two alleged fathers.

 

The DNA report clearly indicated that the children had different fathers although they were born by the same mother at the same time and were legally classified as twins.
